§ 1 Preliminary provisions
The online store Ptak Warsaw Expo (hereinafter referred to as the "Store"), available at the internet address www.biletynatargi.com, is run by Ptak Warsaw Expo with its registered office at al. Katowickiej 62, 05-830 Nadarzyn, entered into the National Court Register by the District Court for the Capital City of Of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000671001 with share capital of PLN 83,818.00, NIP 5342544579 and REGON 366965350.

These Regulations are addressed to both Consumers and Entrepreneurs using the Store and define the rules of using the Store and the rules and procedure for concluding Sales Agreements with the Customer at a distance via the Store.

§ 2 Definitions

Consumer - a natural person concluding a contract with the Seller as part of the Store, the subject of which is not directly related to its business or professional activity.

Seller - Ptak Warsaw Expo with headquarters at al. Katowickiej 62, 05-830 Nadarzyn, entered into the National Court Register by the District Court for the Capital City of Of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000671001 with share capital of PLN 83,818.00, NIP 5342544579 and REGON 366965350.

Client - any entity making purchases through the Store.

Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, the separate law of which grants legal capacity, performs in its own name an economic activity that uses the Store.

Shop - an online store run by the Seller at the internet address www.biletynatargi.com.

Contract concluded at a distance - an agreement concluded with the Customer as part of an organized system of concluding distance contracts (as part of the Store), without simultaneous physical presence of parties, with the exclusive use of one or more means of distance communication up to the conclusion of the contract, inclusive.

Regulations - these Regulations of the Store.

Order - Customer's declaration of intent submitted via the Order Form and aiming directly at concluding a Product Sales Agreement or Products with the Seller.

Account - Customer account in the Store, it contains data provided by the Customer and information about orders placed by him in the store.

Registration form - a form available in the Store, enabling the creation of an Account.

Order form - an interactive form available in the Store that allows placing an Order, in particular by adding Products to the Basket and defining the terms of the Sales Agreement, including the method of delivery and payment.

Shopping Cart - an element of the Store's software in which the Products selected for purchase are displayed by the Customer, and it is also possible to set and modify the Order data, in particular the quantity of products.

Product - a movable item available in the Store / a service being the subject of the Sales Agreement between the Customer and the Seller.

Sales Agreement - a Product sales contract concluded or concluded between the Customer and the Seller via the Store. The Sale Agreement also means - applying to the Product features - a contract for the provision of services and a contract for specific work.

§ 3 Contact with the store

The customer may communicate with the Seller using the addresses provided in this paragraph.

§ 4 Technical requirements

To use the Store, including viewing the Store's assortment and placing Orders for Products, you will need:

  • terminal device with access to the Internet and a web browser,
  • active e-mail account (e-mail),
  • enabled cookies.
§ 5 General information

The Seller, in the widest extent permitted by law, is not liable for any interruptions in the functioning of the Store caused by force majeure, unlawful activities of third parties or incompatibility of the Store with the Client's technical infrastructure.

Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Regulations or by providing the necessary personal and address data enabling the Order to be completed without creating an Account.

The prices in the store are given in Polish zlotys and are gross prices (including VAT).

The final (final) amount to be paid by the Customer consists of the price for the Product and the possible cost of delivery (including fees for transport, delivery and postal services), about which the customer is informed on the Store's pages when placing orders, including at the moment expressing the will to be bound by the Sales Agreement.

§ 6 Creating an Account in the Store

To create an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data: name and surname, e-mail address, telephone number.

Creating an Account in the Store is free.

Logging in to the Account is done by entering the login and password set in the Registration Form.

The Customer may at any time, without giving any reason and without incurring any fees, remove the Account by sending an appropriate request to the Seller, in particular via electronic mail or in writing to the addresses provided in § 3.

§ 7 The rules for placing orders

In order to place an Order:

log in to the Store (optional);

select the Product that is the subject of the Order, and then click "Add to basket" (or equivalent);

if the option of placing an Order without registration has been chosen - fill out the Order Form by entering the details of the order recipient and the address to which the Product delivery will take place, select the type of shipment (method of delivery of the Product), enter the invoice data if different from the recipient's details;

Click the "Order and pay" button and confirm the order by clicking the link sent in the email;

choose one of the available payment methods and depending on the method of payment, pay for the order within a specified time, subject to § 8 point 3.

§ 8 Offered delivery methods and payments

1. The Customer may use the following methods of delivery or collection of the ordered Product:

§ 9 Execution of a sales contract

Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed the Order using the Order Form in the Store in accordance with § 7 of the Regulations.

After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation occurs by sending by the Seller the e-mail address provided at the time of placing the Order e-mail address, which contains at least the Seller's statement of receipt of the Order and its acceptance for implementation and confirmation of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

The Customer is obliged to make the payment within 3 calendar days from the date of the Sale Agreement - otherwise the order will be canceled.

The product will be sent by the Seller within the time specified in its description in the manner chosen by the Customer when placing the Order.

If you order Products with different delivery times, the delivery date is the longest given date.

The beginning of the delivery of the Product to the Customer starts from the date of crediting the Seller's bank account.10. The delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. The delivery costs of the Product (including transport, delivery and postal fees) are indicated to the Customer on the Store's websites in the "Delivery costs" tab and when placing the Order, including when the Customer wishes to be bound by the Sales Agreement.

§ 10 Return

According to the Consumer Rights Act, it is not possible to withdraw from a distance contract in the case of tickets for fairs:

Art. 38. The right to withdraw from a contract concluded outside the business premises or at a distance shall not be granted to the consumer

with regard to contracts:

(...)

12) for the provision of accommodation services, other than for residential purposes, transport of goods, car rental,

gastronomy, services related to leisure, entertainment, sports or cultural events,

if the contract indicates the day or period of service provision;

§ 11 Complaint

Complaints should be reported in letter or by e-mail within 14 days to the addresses of the Seller provided in these Regulations.

The Seller will respond to the claim immediately, no later than within 30 days, and if he does not do so within this period, it is considered that the Customer's request was considered justified.

If it is impossible to carry out the object of the Product, the Seller will refund to the Customer within 30 days the amount he incurred for his purchase for the voucher, enabling the purchase of other Products. The previous sentence does not apply in the event of force majeure, where the non-performance of the Product was due to reasons beyond the control of the Seller.

§ 12 Out-of-court ways to handle complaints and redress

Detailed information on the Consumer's possibilities of out-of-court settlement of complaints and rules of access to these procedures is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorate Inspectorates Handlowa and the following Internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.

The consumer has the following exemplary possibilities to use extrajudicial ways to handle complaints and redress:

The consumer is entitled to apply to the permanent amicable consumer court, referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection, with a request to settle the dispute arising from the Contract concluded with the Seller.

The consumer is entitled to apply to the provincial inspector of the Trade Inspection, pursuant to art. 36 of the Act of 15 December 2000 on the Trade Inspection, with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.

The consumer can get free assistance in settling the dispute between him and the Seller, also using the free help of the poviat (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).

§ 13 Personal data in the store

The administrator of your personal data is PTAK WARSAW EXPO sp. O.o. with headquarters in Nadarzyn (05-830), Al. Katowicka 62, KRS 0000671001. Providing personal data is voluntary, but necessary for the conclusion and implementation of the contract of sale through the Store and fulfillment of legal obligations incumbent on the Administrator. Therefore, your personal data will be processed based on the content of art. 6 par. 1 point b and point c of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC ( RODO). The recipients of the Buyer's personal data may be: carriers or their intermediaries performing the delivery of parcels, entities providing electronic payment services or through payment cards, IT suppliers, service providers in the area of ​​analytical activities. Your personal data is not transferred to third countries. Personal data will be stored until the end of the contract for the provision of services / sales contract with the Seller and for the time necessary to comply with the obligations imposed by the applicable law. You have the right to request access to your personal data, rectification, deletion or limitation of processing, as well as the right to transfer data. In addition, you have the right to lodge a complaint with the supervisory body - the President of the Office for the Protection of Personal Data. Providing personal data is voluntary, but failure to provide the personal data specified in the Regulations necessary to conclude a Sales Agreement results in the inability to conclude this contract.

§ 14 Final Provisions

Agreements concluded via the Online Store are concluded in Polish.

The Seller reserves the right to make changes to the Regulations for important reasons, it is: changes in the law, changes in methods of payment and delivery - to the extent to which these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer about each change at least 7 days in advance.

In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; Act on the provision of electronic services; Consumer Rights Act, the Act on the Protection of Personal Data.

The customer has the right to use extrajudicial means of dealing with complaints and redress. To this end, it may lodge a complaint via the EU ODR online platform at: http://ec.europa.eu/consumers/odr/.
